A common misconception. There are several laws and regulations in place to help prevent adulterated and misbranded products. Under the Dietary Supplement Health and Education Act of 1994 (DSHEA) which amended the Food Drug and Cosmetic Act (FD&C Act), FDA has exclusive jurisdiction over the safety and primary jurisdiction over the labeling of dietary supplements. The FTC, under Section 15 of the FTC Act has primary jurisdiction over advertisements of dietary supplements, though FDA and FTC share jurisdiction of internet marketing for supplements. In addition, firms must be aware that offices of State Attorney Generals are tasked with consumer protection and act as “mini FTCs” and certain states have their own natural product regulations. Lastly, plaintiffs and personal injury attorneys are well versed in the FD&C Act, the FTC Act, DSHEA, and consumer protection laws and wait for Warning Letters to be published every Tuesday.
